Banan Beach Terms & Conditions:
These booking terms & conditions, including any revised booking terms & conditions that we may post from time to time, state the terms & conditions under which Banan Beach will provide accommodation and services to you. Please read this section carefully as these are the conditions you agree to yourself and on behalf of your group when you book (including anyone who is added or substituted at a later date). By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these terms & conditions and agree to them yourself and on behalf of the added or substituted persons at a later date.
BOOKING CONDITIONS
By making such a booking, you are deemed to have accepted these booking conditions, which form the basis of our mutual agreement. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them yourself and on behalf of the added or substituted persons at a later date:
You must be at least 21 years of age to book with Banan Beach, and if you are under 21, an adult must accompany you.
You may make a Booking by using our online reservation system or via other channels, e.g., our call centre. Rooms are subject to availability and any applicable taxes and/or service charges as advised during your booking process.
Booking at our property requires the total amount payable at the booking time immediately. You must complete our Banan Beach online booking form; we will forward your confirmation booking and invoice upon receipt. When you receive your confirmation invoice, please check all the details carefully to ensure they are correct, as this forms the basis of the agreement between us. If there are any discrepancies, please bring these to our attention within immediatly. Otherwise, we will assume the details shown are correct. Errors in costing are rare but should there be an incorrect price, we will issue a new invoice and will not be bound by the amount quoted on the incorrect invoice.
As per the rules and regulations of the country, all guests have to be registered, with valid proof of identification provided (passport or Emirates national ID).
You do not acquire the right to the availability of a specific room. Banan Beach reserves the right to substitute your Booking for a similar or a better room category at the Beach of the same or higher standard, at no additional cost to you, if the room category specified in your Booking is unavailable.
Banan Beach may cancel your Booking at any time, without prejudice to any other right it may have: (a) if you are in breach of any of these Terms and Conditions; (b) for security purposes; (c) by order of the Government or any public authority; or (d) due to an event of Force Majeure.
CHALET AND LOFT
Dear Valued clients,
the garden and the pool are made for your enjoyment and recreational use, please help us maintain them in a good condition so we can better serve you and future clients by following these simple instructions.
-No pets allowed inside the pool
-Please do not use soap and/or any overly oily lotion products inside the pool
-Rinse yourself with water before entering the pool
-No glass wear and/or bottles allowed anywhere near the pool.
-No Diving or jumping
-No external sound systems (pleases use the one provided)
-NO propane powered BBQ and/or any propane related items/tools.
-No Liquid fire starter (please use the Cubes)
-Music stops at 11:00 PM
-All Walk-ins must leave by 11:00 PM
Note: Any damages to the facility resulting from any of the above violations will result in a minimum fine of 5,000 Dirham penalty to the occupants.
CHECK-IN AND CHECK-OUT TIME
Banan Beach standard check-in time is 03:00 PM, and check-out time is 12:00 PM . The times may slightly vary, depending on the Resort and the rate booked. You will be advised of your exact check-in and check-out time during your Booking process.
If you would like to extend your check-out time, please get in touch with the reception desk.
In case you decide to depart earlier than expected, please get in touch with the reception desk.
PAYMENT METHODS
Booking Payment
-We accept payments online/walk-in using Visa, Master Card, and American Express credit/debit card in AED.
-Refunds will be done only through the Original Mode of Payment.
-For each addons visitor, an additional charge in accordance with your applicable Accommodation rate will be added to your Accommodation charge.
Property Services Payment
-The assigned Tag number will be used for recording your purchases inside the beach properties. Note: We will NOT deal or provide any services or products to any of OFAC sanctions countries in accordance with the law of UAE.
-Charges are recorded under your Tag number during your stay and are payable on the presentation of an invoice by credit/debit card or at the check-out time at the reception by card or cash. You agree to be personally liable for all Charges incurred.
-For credit card payment, pre-authorization will be taken upon arrival and once the outstanding Charges exceed the pre-authorization, the exceeding amount will be taken accordingly without prior notification.
-All Charges must be settled upon check-out at the latest. Suppose you do not pay the Charges (or any part of them) upon check-out for any reason. In that case, you acknowledge and agree that we may charge the outstanding Charges, if applicable, to your credit card without prior notification.
Taxes
Your Booking may be subject to fees and taxes in the relevant jurisdiction. As a result, you will be required to pay such fees and taxes (including but not limited to VAT) as applicable and by the existing legislation or any legislation introduced in the future. Any tax liability, including disclosure, connected with your Booking will be your responsibility.
Cancellation & Amendments Policy
-Cancellations made at least 48 hours prior to check-in: eligible for a full refund minus the 5% cancelation processing fees. The remaining balance will be transferred to the booking credit card within 21 days as a maximum.
-Cancellations made under 48 hours prior to check-in: eligible for a 50% (fifty percent) refund of the total booking amount. The remaining balance will be transferred to the booking credit card within 21 days as a maximum.
-If a guest cancels their booking on the day of check-in, no refund will be given
-Amendments for booking dates will incur an additional 10% fees
-Amendments for booking dates can be only once, subject to availability.
-Leaving the property early after check-in, no refund can be made.
-In force majeure, an alternate booking date will be offered.
-Special Events, party and public and national holiday non refundable.
FOOD & BEVERAGE
-Liquid fire starter is strictly not allowed to be used or bring from outside.
-External drinks are not allowed to get into the property.
-Outside Shisha (hubbly bubbly) devices are not allowed in the tents or chalet. Upon check-in, these items will be securely checked in by our competent staff. Items can be retrieved at the time of check-out.
-You are allowed to bring your own barbeque material and/or buy it from our stores to grill it yourself.
BEHAVIOUR
-The Company has the right to refuse to enter a guest whose behaviour is detrimental to the enjoyment of others. Our staff are entitled to a safe working environment and our guests to a great experience. Any threats to safety, being physical or verbal, or inappropriate behaviour may result in removal from the property. If the team requires a guest to leave the property, no refunds will be given, and that guest will be responsible for their own behaviour effects.
-We reserve the right to require you or any of your visitors to immediately vacate your room, check-out and leave Banan Beach premises if we consider that you are behaving (or have behaved) in a threatening, abusive or otherwise unacceptable manner which could trigger (or has triggered) a risk to the safety and health of other guests or staff of the Beach or are causing (or have caused) a disturbance or annoyance to other guests or staff of the Resort.
-We reserve the right to refuse you or any of your visitors' entry to the Hotel and cancel your Accommodation if, on arrival, we consider that you or your visitors are under the influence of alcohol or drugs, are unsuitably dressed or are behaving in a threatening, abusive, or otherwise unacceptable manner.
-You must comply and must ensure that all of your visitors comply, with all reasonable rules and procedures in effect at the Resort and notified to you, including but not limited to health and safety, security procedures and any other legal requirements.
POOLS, WATERWAYS, WATER-ACTIVITIES
Please be advised that the use of pools, beaches is at your own risk. Banan Beach cannot be held responsible for any form of personal injury, loss, damage, or death caused by the usage thereof (except that nothing affects the liability of Banan Beach for death or personal injury caused by Banan Beach gross negligence or willful misconduct or any other liability which may not be excluded or limited by law
BYOB
Members and Guests that have booked a room (Staying the night) are allowed to bring External drinks into Banan Beach however there will be a charge levied for each bottle, Can or liter etc... Contact us for further details.
Valuables
-Money, jewellery and other valuables are brought to the Resort at your own risk and must be placed in the safe deposit box available in your room or at the reception.
-To the extent permissible by any applicable law, no responsibility is accepted by Banan Beach (including our employees) for loss or damage to any guest property which is not placed in a safe deposit box, except where such loss or damage is caused by the gross negligence or willful misconduct of Banan Beach.
-You must report any loss of or damage to your property immediately upon discovery and must make yourself available to assist with any reports produced by us to the police. Banan Beach shall have no liability to you if you fail to submit such notice immediately or you fail to assist with any reports to the police.
DISCLAIMER
-All information and systems are the property of Banan Beach. Neither Banan Beach nor any of its agents or representatives shall be liable for any damage, loss, expenses, or liability of whatsoever nature arising from the use or inability to use this website or the services or content provided from and through this website and at the beach property. Furthermore, Banan Beach makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this website are free from errors or omissions or that the service will be uninterrupted and error-free. Users are encouraged to report any possible malfunctions and errors to info@bananbeach.com.
-Although Banan Beach has taken reasonable steps to provide our guests with a safe experience, certain risks are inherent in each activity and usage of the facilities and cannot be eliminated without destroying their unique character. These inherent risks can be the cause of loss of or damage to equipment, accidental injury, and illness, or in extreme cases, permanent trauma, or death. The Company disclaims responsibility for the activities its clients choose to participate in, and these clients accept full responsibility for risks identified herein and any inherent risks not specifically identified. Participation in any activity and usage of facilities is purely voluntary and is at the sole election of the client in spite of and with full knowledge of the inherent risks. You agree to take all prudent measures in relation to your own safety while using the beach facilities, including, but not limited to, the proper use of pools, private pools, beach, swings, hammocks, and obeying all verbal or written warnings regarding health and safety. The Company is not liable for loss or damages caused by your failure to comply with safety instructions or warnings.
-You are responsible for any loss or damage to the Beach Resort property, furnishings, fittings or equipment (including, without limitation, towels and linen) caused by you or any of your visitors. Amounts required to remedy any damage caused will be charged at your sole expense in
-Under no circumstances may you take photographs of the Banan Beach Resort premises to sell or any other commercial purpose without our written permission.
-Pets are allowed at the Beach on annonnced days/dates with a damage deposit. Pets shall not be left unattended in your room unless notified to the front office and housekeeping. Pets or other animals are not allowed at Beach restaurants and the swimming pool. The deposit less any deduction for damages, if applicable, will be refunded upon check-out.
-Pets must be up-to-date on all vaccinations
-Overly aggressive pets are not allowed
-Fleas, ticks, or bugs carrying pets are not allowed (Even though vaccinated)
-An additional cleaning fee may be charged if pets cause damage or excessive mess
-Excessive barking or noise may result in eviction without refund
-Pet owners are liable for any damage or injuries caused by their pets
-Children under the age of 12 must be supervised by an adult at all times.
-To the extent permissible by any applicable law, Banan Beach excludes all liability and responsibility for Banan Beach for loss or damage of whatever nature arising from or in connection with your Beach stay, regardless of whether such loss or damage would occur in the ordinary course of events or otherwise, is reasonably foreseeable or otherwise, or is caused by any error or omission of Banan Beach (whether negligent or not), except that nothing affects the liability of Banan Beach for death or personal injury caused by the gross negligence or willful misconduct of Banan Beach or any other liability which may not be excluded or limited by law.
-Banan Beach holds the right to cancel or refuse any booking at any time.
-Banan Beach will not be liable to you or any of your visitors for any loss or damage to property caused by the misconduct or negligence of another guest.
-Banan Beach would not be liable to you for any failure or delay in performing any of our obligations if the failure or delay was due to an event of Force Majeure.
-If any provision of these Terms and Conditions is deemed unlawful, void, or for any other reason unenforceable, then that provision shall be considered to be severed from the Terms and Conditions and shall not affect the validity and enforceability of any other provisions.
-Banan Beach failure to exercise or enforce any rights or provisions of the Terms and Conditions will not constitute a waiver of such rights or provisions.
-Nothing in these Terms and Conditions shall create a contractual relationship with, or cause of action in favour of, any third party. Any rights of any third party to enforce these Terms and Conditions under any applicable legal principle, statute or otherwise are excluded.
-General words shall not be given a restrictive interpretation because of their being preceded or followed by words indicating a particular class of assets, matters or things.

Please read these conditions carefully. We want you to be satisfied with your stay at Banan Beach. Therefore, on accepting these Terms & Conditions, we warrant that you have read and accepted these conditions both on your behalf and all persons named under your booking. It is essential and a requirement of our contract that you also carefully and thoroughly read and abide by all the information we provide you with at any stage for your own safety and security. This information also forms part of our contract where it relates to your confirmed stay arrangements.
